We will endeavour to assist you with identification of possible work opportunities, according to the following terms:
1. The Highfield Company will not, under any circumstance, charge fees to a candidate in exchange for finding them a job. Any request for money from an entity pertaining to be The Highfield Company is fraudulently using the company name and should be reported to us.
2. The Highfield Company acts as an employment agency and an employment business is defined in the Employment Agencies Act 1973 and the Conduct of Employment Agencies and Employment Businesses Regulations 2003. In order to comply with our legal obligations, we will obtain adequate information about what our client requires and the candidate's suitability for a role; ensure a candidate has any qualifications required by law, including carrying out a criminal record check if necessary; obtain written consent from a parent or guardian when taking on a person under 18; pay workers for any work done - even if no payment has been received from our client; provide candidates with written details of all chargeable services, including details of their right to cancel together with the notice period required.
3. By law, The Highfield Company must keep sufficient records to show that they have complied with all the provisions of the Employment Agencies Act 1973 and the Conduct Regulations 2003. This includes details relating to applications received from work-seekers, hirers, and its dealings with other agencies and employment businesses, except where it takes no action in respect of the application.
4. The Highfield Company shall not be responsible for any failure to provide the recruitment services as a result of circumstances beyond its reasonable control. The Candidate accepts that The Highfield Company shall not be liable for any failure to provide recruitment services as a result of the Candidate's failure to comply with these Conditions.
5. The Candidate hereby undertakes that the details and CV they submit to The Highfield Company are a true and accurate reflection of their education, employment, training history and that their personal details are correct; that if any of the information submitted to The Highfield Company for the purposes of securing employment is found to be false or inaccurate in any way, that The Highfield Company reserves the right to remove those details and/or suspend the use of the services for the Candidate;
6. The Candidate agrees that they have read, understood and agreed to the Privacy Statement on the Site; will keep confidential and not disclose to any person the password used by them; will be responsible for any misuse of all such passwords.
7. The Highfield Company will not be liable for any failure to secure employment or consequential loss (whether caused by the negligence of The Highfield Company, its employees or agents); any delay, costs, expense, loss, damage or liability (including without limitation as a result of any hardware failure, provision or use of software, virus, deletion, corruption, loss or removal of data) howsoever caused arising from any matter beyond the reasonable control of The Highfield Company or as a result of the acts or omissions of the Candidate; any loss or damage whatsoever howsoever caused arising out of the negligence, dishonesty, misconduct, breach of faith, incompetence, or the wrongful disclosure of confidential information by, any Client; any breach of agreement or infringement or violation of any right of any person or be rendered liable to any proceedings whatsoever, as a result of any information or CV or Application submitted to it by the Candidate and the Candidate indemnifies The Highfield Company against all costs, claims, damages, loss, expenses and liabilities suffered or incurred by The Highfield Company as a result of this undertaking and warranty being incorrect.
8. The Candidate agrees and acknowledges that no condition, warranty or representation of any kind is, has been, or will be, given by or on behalf of The Highfield Company in respect of or in connection with the recruitment services and accordingly the Candidate confirms that it has not, in accepting these Conditions, relied on any condition, warranty or representation by The Highfield Company or any person on its behalf, express or implied, whether arising by law or otherwise in relation to or in connection with the services. The benefit of any such condition, warranty or representation by The Highfield Company is hereby irrevocably and unconditionally waived by the Candidate.
